By booking or participating in any related services (a “service”) with Your Pooches BF (“Your Pooches BF” or “Customer Service” or “Management” or “The Pet Care Professional”), you (“you” or “The Owner”) agree to these Terms & Conditions (the “Terms”).
THE BOOKING CONTRACT.
OVERNIGHT PET CARE DEPOSITS.
At the time of booking a non-refundable deposit of 45% of the service total is due. Full payment is due 30 days before the arrival date of service included in the applicable booking. If the booking is made 30 days or less prior to the arrival date of service, full payment is due at the time of booking. If full payment is not received by the applicable due date, Your Pooches BF may, at its sole discretion, change the rate payable for the booking, or treat the booking as cancelled and retain the deposit paid on booking as a cancellation fee. The booking dates are held and a contract exists when Customer Service issues a written confirmation after receipt of the applicable deposit amount. Please check your confirmation carefully and report any incorrect or incomplete information to Customer Service immediately. You must be at least 18 years of age to make a booking. You agree to provide full, complete and accurate information to Customer Service.
Lifetime Deposit.
If you cancel your booking, and that cancellation is not a result of nonpayment or any other breach of these Terms, the deposit amount will be held as a “Lifetime Deposit”, subject to these Terms. Lifetime Deposits have no expiry and may be applied towards payment of a deposit on any other booking scheduled. The Lifetime Deposit is transferable and may be transferred by you to another individual of your choosing by providing notice to Customer Service in writing.
SERVICE CREDIT.
If you cancel your booking, and that cancellation is not a result of nonpayment or any other breach of these Terms, 80% of the service amount will be held as a “Service Credit”, subject to these Terms. Service Credits have no expiry and may be applied towards payment of a service on any other booking scheduled. The Service Credit is transferable and may be transferred by you to another individual of your choosing by providing notice to Customer Service in writing.
CANCELLATIONS OF OVERNIGHT PET CARE BOOKING.
Cancellation received 60 days or more before arrival of service in relevant booking: Lifetime deposit will be held in accordance with these Terms and the remainder of the payments made in respect of the cancelled Service will be refunded.
Cancellation received 59-30 days before arrival of service in relevant booking: Lifetime Deposit will be held in accordance with these Terms, an amount equal to 50% of the remainder of the payments made for the cancelled booking will be refunded.
Cancellation less than 30 days before departure of service in relevant booking: Lifetime Deposit will be held in accordance with these Terms, and no further refund will be payable. For certain services, alternative cancellation terms may apply. You will be advised of any such requirements prior to confirmation of the applicable booking.
CHANGES OF OVERNIGHT PET CARE BOOKING.
In the event of any modifications to your itinerary where reasonably required you agree to provide notice as soon as possible, provided that there is sufficient time to do so before departure.
If a Change is made more than 60 days before arrival of service, Lifetime deposit will be held and the remainder of payments for the original itinerary will be refunded.
If a Change is made 59-30 days before arrival of service, Lifetime deposit will be held and an amount equal to 50% of the remainder of the payments made for the original itinerary will be refunded.
If a Change is made less than 30 days before arrival of service, Lifetime deposit will be held and no further refund will be payable. If Change or Cancellation has been made less than 59-30 days before arrival of service you may choose to:
book another service of equal or greater value, if available (you will be responsible for paying any difference in price); or
book another product or service of lesser value, if available (with a credit payable to your account for the difference in price); or
cancel the amended service and receive a 50% refund or Service Credit for the portion of the remainder of payments made for the original itinerary, Lifetime deposit will be held.
If Change or Cancellation has been made less than 30 days before arrival of service you may choose to:
book another service of equal or greater value, if available (you will be responsible for paying any difference in price); or
book another product or service of lesser value, if available (with a credit payable to your account for the difference in price); or
cancel the amended service and receive a 50% Service Credit to your account for the portion of the remainder of payments made for the original itinerary, the remaining 50% of the payments and Lifetime Deposit will be held.
Upon arrival of service, itinerary changes may be necessary for you as a result of unforeseen circumstances. Any Changes or Cancellations fee’s are at the discretion of Management. Your Pooches BF will not be liable for any indirect and or consequential losses associated with any changes to a booking. Changes made by you: You are responsible for ensuring that information provided to the Customer Service is accurate and up-to-date. Any changes to a booking depend on availability and are subject to Management’s approval and these Terms. Any extra costs incurred for making the change will be charged to you along with an administrative fee. Cancellation of any service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms.
CANCELLATION OF CHECKUPS OR WALKS.
Cancellation within 24 hours or more before arrival of service: you will receive a full refund.
Cancellation less than 24 hours before arrival of service: No refund will be payable. 80% of the payment amount will be applied to your account as a Service Credit and the remaining 20% of the payment will be held.
MONTHLY BOOKINGS.
Monthly walks/checkups are on a monthly basis running from the 1st date of service through the last day of the month; a total of 30 days.
Up to five Walks/Checkups a week
The monthly rate is payable one (1) month in advance. It is due and payable on the first (1st) day of the service and must be paid not later than five (5) days after due date. Failure to do so will automatically cancel this Agreement and the customer will be charged the prevailing service rate.
No deductions or allowances from the monthly rate will be made for days customer does not use Your Pooches BF walking/checkup services.
This Agreement may be terminated by Your Pooches BF upon 15-day notice to customer.
Your Pooches BF reserves the right to adjust rates upon 30-day notice to customer.
Customer reserves the right to terminate agreement upon 15 day notice. Any Monthly Booking of less than 15-day notice may be subject to a $1o5 cancellation fee.
LAST MINUTE BOOKING.
Any booking of less than 48 hours of notice may be subject to a 50% surcharge of regular service price.
THE PET CARE PROFESSIONAL'S OBLIGATIONS.
The Pet Care Professional shall:
devote as much productive time, energy, and ability to the performance of his/her duties under this agreement as may be necessary to provide the required Services in a timely and productive manner
perform the Services in a reliable, caring, and trustworthy manner using fully-skilled, competent, and experienced personnel;
perform the Services in accordance with standards prevailing in the Pet Care Professional’s industry, and in accordance with applicable law, rules, or regulations, and obtain all permits or permissions required to comply with those standards, laws, rules, or regulations;
pay all ordinary and necessary expenses, to maintain bonding and insurance;
carry out all the Owner’s instructions as to the care of the Pet(s);
make every reasonable effort to ensure the good health and comfort of the Pet(s) while abiding by the instructions of the Owner;
communicate with the Owner regarding the Pet Care Professional’s performance of the Services;
provide services (including the Services) that are satisfactory and acceptable to the Owner; and
refrain from unlocking or opening doors or gates on the Owner’s property for anyone at any time unless receiving the Owner’s approval prior.
EXCLUSION OF LIABILITY.
The Pet Care Professional and Your Pooches BF are not responsible for:
losses, fines, injuries, or deaths resulting from actions of the Pets, if these actions occur because the Owner has left the Pets outside or has instructed the Pet Care Professional to leave the Pets outside while the Pet Care Professional is not there, including pets with doggie doors or outdoor pets;
complications suffered by the Pets or the actions of the Pet(s) while left unattended;
costs (including medical care and attorneys’ fees) related to the Pet(s) biting of another person or animal;
liability related to transportation, veterinarian treatment, and expenses for the Pet(s);
expenses resulting from the Pet’s destructive behavior in the house or any house soiling; and
damages resulting from the Pet Care Professional’s performance of additional services, including wilting or dead indoor or outdoor plants, damage to trash cans by trash service, damaged mail, or newspapers. Any additional services will be performed by the Pet Care Professional specifically as requested and instructed by the Owner.
Independent Contractor Status.
The Home & Pet Care Professional shall perform the Services solely as an independent contractor and is not an employee of Your Pooches BF. Nothing in this agreement may be construed as creating a joint venture, partnership, franchise, agency, employer-employee, or similar relationship between the parties, or as authorizing either party to act as the agent of the other. The Pet Care Professional is and will remain an independent contractor in his/her relationship to the Owner. The Owner is not responsible for withholding taxes with respect to the Pet Care Professional’s compensation under this agreement. The Pet Care Professional will have no claim against the Owner under this agreement or otherwise for vacation pay, sick leave, retirement benefits, social security, worker’s compensation, health or disability benefits, unemployment insurance benefits, or employee benefits. Nothing in this agreement creates any obligation between either party and a third party.
THE OWNER'S OBLIGATIONS.
The Owner is the owner of the animals in care (the “Pet(s)”) and shall;
make timely payments of amounts earned by the Pet Care Professional under this agreement;
provide a set of working keys to the Owner’s home for the Pet Care Professional to carry;
which may not be left hidden outside by either party;
provide sufficient instructions to arm and disarm any burglar alarm system in the Owner’s home;
“pet-proof” the Owner’s home and yard and secure any gates, latches, or fences prior to leaving. The Pet Care Professional is not responsible for injury, disappearance, death, or fines of the Pet(s) if there’s unsupervised access to the outdoors;
lock all windows, screens, and doors before leaving the home unattended for the safety and security of the Pet(s), property, and the Pet Care Professional;
have sufficient pet food, medication, cleaning supplies, and other important provisions readily available to the Pet Care Professional before the Owner’s departure, and reimburse the Pet Care Professional for all resupplies of products needed for the satisfactory performance of his/her duties;
make payment arrangements with a qualified veterinarian for veterinary consultations or procedures the Pet Care Professional incurs on behalf of the Pet(s);
provide relevant information to help the Pet Care Professional in performing the Services; and
satisfy the Pet Care Professional’s reasonable requests for assistance in his/her performance of the Services;
maintain a clean and healthy environment that is free of hazards that the Owner knows or should know about, and that are causing or are likely to cause death or physical injury. For example hazards can be unsafe conditions such as: toxic fumes (including fecal matter, urine or dead carcasses), broken equipment, or clutter in main walkways or common areas.
OWNER’S REPRESENTATIONS.
The Owner hereby represents:
the Owner is the actual owner of the Pets;
the Pets are current on rabies vaccination and [has][have] received other regular vaccinations or satisfactory titer level results from a certified veterinarian;
the Pets have no history of vicious or violent behavior; and
the emergency contacts listed;
have been notified that they have been designated to make decisions on the Owner’s behalf in the case of an emergency.
